The Evidence Hierarchy: Why Not All Documentation Is Created Equal

A handwritten note from your manager is not the same as a company-wide email. Understanding the 4-tier evidence classification system is the foundation of the Force Multiplier methodology.

Why Evidence Quality Matters More Than Quantity

Many people approach employment discrimination cases with a "more is better" mentality — collecting every email, every text message, every note. But quantity without quality is noise.

The Force Multiplier Evidence Hierarchy is built on a simple principle: **evidence quality determines settlement value**. A single Tier 1 piece of evidence is worth more than 50 Tier 3 pieces.

The Four Tiers

Tier 1: Direct Discriminatory Intent

This is the gold standard. Examples include:

  • Direct written statements expressing discriminatory intent
  • Recorded statements (where legally obtained)
  • Internal communications explicitly referencing protected characteristics in employment decisions
  • Tier 1 evidence dramatically increases settlement value and employer motivation to resolve quickly.

    Tier 2: Circumstantial Pattern Evidence

    This tier includes documented patterns that, taken together, suggest discriminatory intent:

  • Statistical disparities in treatment of similarly situated employees
  • Documented deviations from stated company policy
  • Temporal proximity between protected activity and adverse action
  • Tier 3: Supporting Context Evidence

    This tier provides context but doesn't establish discrimination on its own:

  • General workplace culture documentation
  • Witness statements without direct knowledge
  • Circumstantial behavioral patterns
  • Tier 4: Background Documentation

    This is the foundation — necessary but not sufficient:

  • Employment records, performance reviews, pay stubs
  • Organizational charts and reporting structures
  • Company policies and handbooks
