1. Does this evidence directly establish discriminatory intent?
2. Does this evidence create a pattern that suggests discrimination?
3. Does this evidence support or contextualize other evidence?
4. Is this evidence necessary for establishing the baseline facts?
A strong evidence portfolio has evidence at multiple tiers, with at least one piece of Tier 1 or strong Tier 2 evidence as the anchor. The portfolio structure determines which multiplier applies in the Settlement Math formula.
